1. Acceptance of Terms

By accessing or using MonitorVPS ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms constitute a legally binding agreement between you and Techinate Aktiebolag, a company registered in Sweden.

2. Service Description

MonitorVPS is a server monitoring service that allows you to track the performance and health of your VPS servers. The Service collects and displays metrics including but not limited to CPU usage, memory usage, disk usage, uptime, and process information.

To use the Service, you must install our monitoring agent on your servers. The agent collects performance data and transmits it to our servers located in the European Union.

3. Account Rules

When creating an account, you agree to the following rules:

• One account per person or entity. You may only create one account. Creating multiple accounts to circumvent service limits or for any other purpose is strictly prohibited.
• No account sharing. Your account credentials are personal and may not be shared with others.
• Accurate information. You must provide accurate and complete information when creating your account.
• Account security. You are responsible for maintaining the security of your account and password.

4. Acceptable Use

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service. Specifically, you agree not to:

• Abuse the Service or use it in a way that negatively impacts other users
• Attempt to gain unauthorized access to any part of the Service
• Use automated scripts or bots to interact with the Service in an abusive manner
• Monitor servers used for illegal activities
• Circumvent any limitations or restrictions placed on your account
• Create multiple accounts to bypass free tier limitations
• Resell or redistribute the Service without authorization

5. Service Tiers & Payments

MonitorVPS offers both free and paid service tiers:

• Free Tier: Monitor up to 2 servers with core features at no cost.
• Pro Tier: Monitor up to 5 servers with additional features for an annual subscription fee.
• Ultra Tier: Monitor up to 10 servers with all features for an annual subscription fee.

Payments are processed by Paddle, our payment provider. By subscribing to a paid tier, you agree to Paddle's terms of service. You may upgrade, downgrade, or cancel your subscription at any time through your account settings.

We reserve the right to modify pricing with 30 days notice to existing subscribers.

6. Refunds

We offer a 30-day money-back guarantee on all paid subscriptions. If you are not satisfied with the Service for any reason, you may request a full refund within 30 days of any payment, no questions asked.

To request a refund, simply email us at support@monitorvps.com with your account email address. Refunds are processed through Paddle and will be returned to your original payment method within 1-5 business days.

7. Termination

You may terminate your account at any time by contacting us or through your account settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

We reserve the right to suspend or terminate your account immediately, without prior notice, if we determine that you have violated these Terms of Service. This includes, but is not limited to, creating multiple accounts, abusing the Service, or engaging in any prohibited activities.

8. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, Techinate Aktiebolag shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Modifications to Terms

We may modify these Terms of Service at any time. We will notify you of significant changes by email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated terms. If you do not agree to the modified terms, you should discontinue use of the Service.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Sweden. Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Sweden. For users in the European Union, this does not affect your statutory rights under applicable consumer protection laws.
